Terms of Use
Read section 3 before you train. System Quest counts reps with a camera. It is a game, not a coach and not a medical device. You are responsible for training safely and for knowing your own limits.
1. Agreement
These terms are a contract between you and the independent developer of System Quest ("we", "us"). Downloading, installing or using the app means you accept them. If you do not, do not use the app. Apple is not a party to this agreement and has no responsibility for the app or its content.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use System Quest on Apple devices you own or control, in line with Apple's App Store Terms of Service. You may not copy, sell, sublicense, reverse-engineer, decompile or modify the app, or attempt to extract its source code or bundled models, except where that restriction is prohibited by law.
3. Health, safety and the limits of rep counting
System Quest is a fitness game. It is not medical advice, physiotherapy, personal training or a medical device. Nothing in the app diagnoses, treats or prevents any condition.
- Consult a doctor before starting this or any exercise programme, especially if you are pregnant, recovering from injury or illness, have a heart or joint condition, or have been inactive for a long time.
- Stop immediately if you feel pain, dizziness, chest discomfort or shortness of breath, and seek medical attention.
- Rep counting is an estimate. The app judges your movement from a camera image. It can miscount, miss reps, count reps that were not clean, or fail to detect you entirely — because of lighting, camera angle, clothing, background or anything else. A counted rep is not a judgement that your form was safe or correct.
- Quest targets are generated by a game, not prescribed by a professional. They take no account of your medical history. Never push through pain to finish a quest, protect a streak or hold a rank. Scale down, rest, or skip the day.
- Set up your space. Clear the area, secure your phone so it cannot fall, and make sure your surface and any bar you use are stable and can take your weight.
You take part in physical exercise at your own risk, and you are solely responsible for your own safety and for any injury or loss that results from using the app.
4. Eligibility and your account
You must be at least 13, and old enough to consent to data processing where you live, to use System Quest. If you are under 18, use it only with a parent or guardian's permission.
You sign in with Apple or Google. Keep that account secure — anything done through your sign-in is treated as done by you. Give accurate information, and keep it up to date. One person, one account.
Using System Quest also means complying with the terms of the third-party services it relies on — including Apple's Media Services Terms and Conditions, and the terms of whichever provider you sign in with.
5. Fair play
Rank is meant to reflect work you actually did. Do not manipulate the rep counter — for example by filming a screen, a video, another person, or a repeated partial movement made to trip the detector. Do not tamper with the app or its network traffic to award yourself rank points, coins or ranks. We may reset progress, or suspend or close an account, where we reasonably believe this has happened.
Also, do not:
- use the app for anything unlawful, or to harass or harm anyone;
- upload a profile photo that is illegal, obscene, hateful, or not yours to use;
- attempt to gain unauthorised access to our systems, disrupt the service, or access another player's data;
- use automated means to access the service at abnormal volume.
6. Virtual items
Rank points, coins, ranks, levels and streaks are part of a game. They have no monetary value, are not property, cannot be bought, sold, transferred or exchanged for anything of real value, and cannot be redeemed for cash. We may adjust game balance — including how much anything costs or pays — as the game develops. Losing virtual items, for any reason, entitles you to no compensation.
7. Beta software
While System Quest is distributed through TestFlight or labelled as a beta, it is pre-release software provided for testing. Expect bugs, incorrect counts, interrupted service and occasional loss of progress. Beta builds expire, and features may change or be removed without notice. Use of TestFlight is also subject to Apple's own terms.
8. Changes to the app and the service
The app updates itself over the air, so the version you run may change without a new download from the App Store. We may add, change, suspend or discontinue features, or the whole service, at any time. We will give reasonable notice in the app where a change would materially affect your progress.
9. Our content and yours
The app — its code, design, artwork, rank emblems, wordmark, sounds, text and game systems — belongs to us or our licensors, and is protected by copyright and other laws. Third-party components, including the MediaPipe pose model (© Google, Apache-2.0) and the Orbitron and Electrolize typefaces (SIL Open Font License 1.1), remain the property of their respective owners and are used under their licences.
Anything you supply, such as a display name or profile photo, stays yours. You grant us only the permission needed to store it and show it back to you in the app. You confirm you have the right to use whatever you upload.
10. Ending your use
You can stop at any time by deleting your account in Settings → Danger → Delete Account, which erases your data as described in the Privacy Policy, and then deleting the app. We may suspend or end your access if you materially breach these terms, if required by law, or if we discontinue the service. Sections 3, 6, 9, 11 and 12 survive the end of this agreement.
11. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that rep counting will be accurate, or that your data will never be lost. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits or goodwill, arising out of your use of the app. Our total liability for all claims relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or USD 50.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud. If you are a consumer, you keep all mandatory rights granted by the consumer law of your country, and nothing here overrides them.
13. Apple
These terms are between you and us alone. Apple has no obligation to provide support for the app. Apple is not responsible for any claim that the app fails to conform to a warranty, for product liability claims, or for any claim that the app infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms. The version and effective date at the top will change, and the current version always lives at systemquest.fit/terms. Material changes will be announced in the app before they take effect. Continuing to use the app afterwards means you accept the new terms.
15. Governing law
These terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws rules, and the courts of Vietnam have jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of your own country, or of the right to bring proceedings there. If any provision of these terms is held unenforceable, the rest remain in force.
